Water Law

Water rights pertain to the legal rights of property owners to the access and use bodies of water adjacent to lands they hold. Different types of waters rights exist based on various forms of water that border or exist on a property.


In Queensland you may require an authorisation from the Department of Natural Resources, Mines and Energy (DNRME) for an activity in a water area. An authorisation may be in the form of a tradable water allocation, water licence, water permit or seasonal water assignment.


In Queensland you may need a water licence for taking or interfering with surface water, overland flow water or underground water.
